1. Introduction

This Recruiter Agreement is an agreement between you (“you” or “recruiter” refers to freelance recruiter) and workbrook LLC (referred to as “Workbrook”, “we” or “us”) and, to the extent expressly stated, Green Harbour Limited (referred to as “Green Harbour”). You must read, agree to, and accept all of the terms and conditions contained in this Agreement to be a recruiter on our mobile applications and web application (referred to as “workbrook”, “software”, “platform”, “application” or “app”).

If you reside in Nigeria, you are entering into this Agreement with Green Harbour Limited.

This agreement is an addition to the User Terms and Conditions and not a substitute. You are not eligible to become a Recruiter on workbrook unless you have accepted the User Terms and Condition, all details of the User Terms and Conditions apply to all Recruiters on our platform.

2. Becoming A Recruiter on workbrook

Workbrook provides you with a platform to offer freelance recruitment services to users looking to recruit into vacancies posted on our platform. BY SIGNING UP TO BECOME A RECRUITER ON OUR PLATFORM AND CLICKING ON “BECOME RECRUITER”, YOU ARE COMMITTING TO AN AGREEMENT WITH WORKBROOK TO PUT YOUR FREELANCE RECRUITMENT SERVICES UP FOR HIRE THROUGH OUR PLATFORM.

3. Recruiter Services

A user posts a job on workbrook and makes a decision to hire recruiters through the platform. Once a user clicks on “hire recruiter” that user becomes “a Client”, looking to hire the services of a recruiter through workbrook.

A Client may request the services of recruiters on the platform, you may receive a request to provide recruiter services through our Platform. The Client may request the services of more than one recruiter at a time, for a job.

You may decline a Client’s request to provide recruitment services if you so choose.

BY CLICKING ON “ACCEPT REQUEST” YOU BECOME THE “ACTIVE RECRUITER” TO “THE CLIENT” AND COMMIT TO AN AGREEMENT WITH THE CLIENT TO PROVIDE RECRUITMENT SERVICES THROUGH OUR PLATFORM AND YOU AGREE:

To share your information on the platform with the Client and in turn the job owner in order to be considered for the provision of recruitment services

That Workbrook reserves the right to introduce other recruiters to the Job poster for the same job in order to ensure speedy delivery of recruitment services to the Client.

That by requesting your recruitment services, the Client is not bound to use your services until you accept the Client’s request, becoming the Client’s Active Recruiter

That the information you have provided on this platform is true and not misleading or misrepresenting your capabilities, skills, knowledge, experience or service fees.

Not to use the information of a job, the Client or the Client’s organization for any other purpose or in any other manner except that which is intended by Workbrook and/or the Client.

Not to circumvent workbrook in order to take up a recruiter service with the Client or the organization the Client represents after being introduced to the Client on our platform.

You agree to provide the Client with a Shortlist of suitable candidates that meet the criteria agreed with the Client. The Client may accept or reject the Shortlist only on the basis of the requirements of the job. You may send a revised shortlist of the Client rejects your initial Shortlist.

4. Recruitment Services for Client- Shortlisting

Once you accept a Client’s request to hire and become the Active Recruiter, you are required to send a list of shortlisted Candidates that meet the requirements of the Client’s Job within 15days of accepting the request.

You agree to send a final list of shortlisted candidates to the Client within 15days of accepting the Client’s request. The Shortlist must be a minimum of 3 candidates who meet the minimum requirements of your job (at least 3 primary candidates).  Once the Client accepts your shortlist- the recruitment service for the role has been completed.

5. Hire Guarantee

You acknowledge that there may be circumstances where an employment of a candidate you presented to the Client is terminated. In the case where the hired candidate leaves the Client for any reason within 90days of the date hired on the platform, you agree to replace the candidate at no additional cost to the Client, provided: 

  • The Client has notified us in writing of the termination of the engagement within the 90days; 
  • The termination is not due to redundancy, change of job specification or employment terms, or relocation of the employment;
  • The Client hired the preferred candidate on the Platform no later than 10days after the candidate formally accepted the offer; and 
  • The Client has paid in full all recruiter charges with 15 days of hiring the candidate on the Platform.

In the event that you fail to replace the candidate within reasonable time, you agree that we may take any action we deem fit and which is required to ensure the Client enjoys full service for the Placement fee paid

6. Recruiter Charges

You agree to indicated your charges for providing hiring services to the Client on your profile. You attest that the recruiter charge information you provide on your recruiter profile is true, accurate and binding on you. You may not review or revise your recruiter charge once you have received a request to provide recruitment services to a user. If you intend to revise your charges, you must first decline all current recruiter service requests before making changes to your recruiter charges. You may not have access to create a recruiter profile if you do not provide all details required. 

YOU AGREE THAT THE RECRUITER CHARGES YOU PROVIDE ON YOUR RECRUITER PROFILE IS BINDING AND CONSTITUTE AN AGREEMENT BETWEEN YOU AND THE CLIENT. 

7. Fees and Payments

Upon hiring a candidate, the Recruiter provided to the Client, the Client (or his/her representative organization) will pay the monetary value of the recruiter charges as Placement Fee which will be credited to the Active Recruiter’s wallet within 30 days of hiring the preferred candidate on the Platform. 

Recruiters agree to pay workbrook a Service fee for using workbrook to provide services to Clients. 

YOU AGREE TO PAY WORKBROOK A SERVICE FEE OF 20% OF THE RECRUITER CHARGES AND 10% OF SERVICE FEE AS DISBURSEMENT FEE.

Once Placement fee is paid by Client:

  • 70% of the Placement fee is paid to Recruiter’s wallet, withdrawable through Recruiter’s preferred payment method; 
  • 20% of the Placement fee is paid to workbrook as Services fee;
  • 10% of the Placement fee is paid to workbrook as disbursement fee 

Disbursement fee covers all handling fees associated with the transactions.

The Placement Fee is calculated based on the Salary offered to and accepted by the preferred candidate and the amount and/or percentage fee indicated on the Active Recruiter’s profile.

The Placement Fee is not subject to reduction even if the candidate’s employment terminates. The Client will be obligated to pay such fee whenever:

A candidate introduced to Client by the Active Recruiter is hired, directly or indirectly, for any position, as an employee, consultant, or independent contractor, by Client, its affiliates, parents, or subsidiaries, within 12 months of the most recent activity on behalf of that candidate by the Active Recruiter OR

A candidate introduced to the Client by the Active Recruiter is referred by the Client to another employer or recruiting firm and the candidate is hired, directly or indirectly, for any position, as an employee, consultant, or independent contractor, by such employer or through such recruiting firm within 12 months of the most recent activity on behalf of that candidate by the Active Recruiter.

8. Candidate Personal Information Confidentiality

All candidate introductions made by the Recruiter to the Client on the Platform are made on a confidential basis and the Recruiter and the Recruiter’s candidates shall hold workbrook harmless from any liability resulting from the Client’s unauthorized disclosure or misuse of information regarding any candidates or their candidacy. 

9. Disclaimer 

WORKBROOK DOES NOT GUARANTEE THE PERFORMANCE OF ANY CLIENT OR THE ACCURACY OF INFORMATION PROVIDED REGARDING A JOB OR CLIENT, AND DISCLAIMS ANY RESPONSIBILITY FOR CLAIM, LOSS, OR LIABILITY AS A RESULT OF A CLIENT’S ACTS OR OMISSIONS. WE URGE THE RECRUITER TO CONDUCT SUCH INVESTIGATIONS, AS IT DEEMS NECESSARY TO VERIFY CLIENT’S INFORMATION OR TO OBTAIN SUCH OTHER INFORMATION, AS IT MAY DEEM RELEVANT.
